Regulations for Online Ticket Sales


§ 1
Definitions
1.    Tickets – tickets for concerts organized as part of the Event.
2.    Concert – all concerts, piano competitions, preliminary rounds for the Chopin Competition, and broadcasts of the Chopin Competition, excluding the International Fryderyk Chopin Piano Competition, as well as concerts within the International Music Festival “Chopin and His Europe,” organized and co-organized by the Fryderyk Chopin Institute.
3.    Event – Festival, Concert, Competition, Broadcast.
4.    Institute – The Fryderyk Chopin Institute, registered in the cultural institution registry under RIK 51/2001, NIP 525-22-14-269, Regon 017307171, headquartered at Tamka 43 Street, 00-355 Warsaw, email: nifc@nifc.pl, phone: (+48 22) 44 16 100, website: http://pl.chopin.nifc.pl/institute/.

§ 2
1.    The purpose of these Regulations is to establish the rules for the online sale of Tickets for concerts as part of the Concert Event, excluding tickets for concerts and events that are subject to separate regulations. Details regarding the concerts within the Concert Event covered by these Regulations will be available on the Institute's website: www.nifc.pl.
2.    The online sale of Tickets is conducted by the Institute. The Institute's website at bilety.nifc.pl (tickets.nifc.pl for the English-language version) allows the purchase of Tickets online.
3.    The Regulations are available on the Institute's website at: https://bilety.nifc.pl.
4.    The online purchase of Tickets is only possible after the Buyer logs into their account, having first registered an account in the online sales system on the Institute's website specified in paragraph 2 above. During account registration, the user's email address is required. To purchase Tickets online, the user's data must be supplemented with their first and last name or PESEL number and address if a request is made to receive an invoice under the terms specified in paragraph 9 below.
5.    Minimum Technical Requirements for Using the Ticket Sales System:
a)    Software: Any web browser that supports JavaScript applications, and a program capable of viewing and printing files in PDF format;
b)    Technical requirements: A computer with Internet access, a Pentium 233 MHz processor or better, RAM: minimum 128 MB, a video card, and a monitor with a Super VGA resolution (800 x 600) or higher.
6.    A Ticket entitles entry only to the specific concert within the Concert Event that was selected by the Buyer during the purchase. Online ticket sales will continue until the day of the given concert within the Concert Event or until the allocation of seats for online ticket sales is exhausted.
7.    Entry to the concert is only possible upon presenting a valid ticket for the concert within the Concert Event, purchased in accordance with these Regulations, unless the Institute has allowed entry under other conditions, e.g., in accordance with the "Online Ticket Sales Regulations" or based on an identifier, accreditation, invitation, or another type of pass.
8.    Tickets may not be resold without the Institute's consent, particularly through auctions, bids, contests, or outside the sales points authorized by the Institute.
9.    The Institute informs that, in accordance with Article 133 of the Polish Petty Offences Procedure Code (May 20, 1971, Journal of Laws 2019, item 821, as amended): “Whoever purchases tickets for artistic, entertainment, or sports events with the intention of reselling them for profit, or whoever sells such tickets for profit, is subject to arrest, restriction of liberty, or a fine. Attempting, inciting, or aiding and abetting are also punishable.”
10.    Tickets purchased in violation of these Regulations, including unauthorized or illegal sources, are deemed invalid and do not grant entry to the Event.
11.    The price indicated at the time the Buyer places the order is binding. All prices are given in Polish zlotys (PLN) and include VAT.
12.    Payment for Tickets purchased online must be made via bank transfer or credit card (Visa, Visa Electron, MasterCard, Maestro, Diners Club, JCB, MasterCard Mobile). The Buyer bears any additional costs associated with making the payment for the Ticket as outlined in this paragraph.
13.    The Buyer can issue an invoice independently during the ticket purchase process by selecting the "invoice" as the sales document.
14.    After the payment is credited to the Institute's account, the Buyer will receive an email notification regarding the activation of the Ticket(s) for printing via the print@home option. The Institute is not responsible for the failure to deliver the notification if the issue is due to reasons attributable to the Buyer (e.g., incorrectly provided email address, full email inbox, etc.).
15.    School-age children, students up to 26 years of age, retirees, and pensioners are eligible for discount tickets (30% off) upon presenting valid documentation at the event. If the required document is not presented, the difference between the discounted and regular ticket price must be paid at the Museum Box Office at Okólnik 1 Street.
16.    A ticket for a concert within the Event can be refunded no later than 10 days before the date of the Event upon submitting an appropriate return form (Appendix No. 1 of the Regulations). The form should be sent to the following address: Narodowy Instytut Fryderyka Chopina, ul. Tamka 43, 00-355 Warszawa, Poland, or to the email address: bilety.koncerty@nifc.pl. The refund for the Ticket purchase will be processed via bank transfer to the account from which the payment was made, within 21 days of receiving the letter mentioned in the previous sentence. The refund amount for the Ticket in the case of the Buyer's cancellation will be 100% of the price of the returned Ticket.
17.    The Institute reserves the right to allocate a pool of complimentary tickets for educational purposes, the promotion of music and culture, as well as for sponsorship and partnership obligations.
18.    In case of a concert cancelation due to force majeure (e.g., natural disasters, terrorist attacks, national mourning, the artist’s unavailability, etc.), purchasers are entitled to a full refund of the ticket price for the specific concert within the Event. To claim a refund, a written complaint must be submitted to the following address: The Fryderyk Chopin Institute, Tamka 43 Street, 00-355 Warsaw, Poland, or via email at bilety.koncerty@nifc.pl, within two months of the planned date of the concert.
19.    Any irregularities in the operation of the online ticket sales system for concerts within the Concert Event may be reported to the email address: bilety.koncerty@nifc.pl or to the address: Narodowy Instytut Fryderyka Chopina, ul. Tamka 43, 00-355 Warszawa, Poland. A complaint should include at least the first and last name of the person submitting the complaint, an address (postal or electronic), and a description of the issues raised. The Institute will review the complaint within 30 days of receiving the email or letter containing the complaint.
20.    Pursuant to Article 38, Section 12 of the Act of May 30, 2014, on Consumer Rights (Journal of Laws 2014.827, as amended), the Buyer is not entitled to withdraw from the agreement under Article 27 of this Act.
21.    The Buyer hereby unconditionally consents to their personal data being included in the Institute's database and to the processing of this data for the purpose of contract execution, including reservations, sales, or returns of Tickets, as well as their settlement and other activities related to the provided service. Providing personal data by the Buyer is voluntary; however, the lack of consent to data processing makes it impossible for the Institute to complete reservations and ticket sales. The Buyer is responsible for providing false personal data. The Buyer has the right to access their personal data, correct it, and request its deletion. The administrator of the aforementioned personal data is the Narodowy Instytut Fryderyka Chopina, headquartered in Warsaw, ul. Tamka 43, 00-355 Warszawa.
22.    The Buyer is entitled and obligated to use the online ticket sales system in accordance with its intended purpose and is required not to engage in any activities that could affect its proper functioning, particularly by interfering with the content of the online ticket sales system or its technical components, or by providing unlawful content.
23.    The Institute has the right to record the course of concerts within the Concert Events using audio and video recording devices. The Ticket Buyer, by participating in the public event based on their ticket, acknowledges that participation in the event is equivalent to granting consent for the free photographing and filming of their person, as well as the recording, broadcasting, and distribution of their voice or image for documentation, reporting, advertising, and promotional purposes in connection with any program or publication in which the recording of the concert within the Concert Event is used, with the right to transfer this consent to third parties.
24.    The online ticket sales agreement is concluded in accordance with Polish law and in the Polish language. In the case of discrepancies between the Polish and English versions of the Regulations, the Polish version is binding.
25.    The Buyer may use out-of-court methods for resolving complaints and pursuing claims. This includes the option of mediation. Lists of permanent mediators and existing mediation centers are provided and made available by the Presidents of the competent District Courts. A Buyer who is a Consumer may also use out-of-court methods for resolving complaints and pursuing claims by submitting their complaint via the EU online ODR platform, available at: http://ec.europa.eu/consumers/odr/.
26.    The Institute is not responsible for email delivery issues caused by email server administrators blocking messages sent to the email address provided by the Buyer or by the deletion and blocking of emails by software installed on the computer used by the Buyer.
27.    The Institute is entitled to amend the Regulations. Buyers will be notified of changes to the Regulations via email sent to the email address provided during the account registration process mentioned in paragraph 4 above. Changes to the Regulations are binding on the Buyer provided they have been informed of the changes and have not terminated the agreement for the provision of electronic services within 14 days of being notified of the changes.
